1. Acceptance of Terms

By accessing or using panoearth ("Site"), owned and operated by cosmigo GmbH, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, strictly do not use the Site.

2. Use of the Site

You may use the Site to browse, search, and purchase Content. You may not:

• Use data-mining, robots, or similar extraction methods contrary to our machine-readable directives.
• Use image Content or image metadata from this Site for text-and-data mining, AI or machine-learning training, fine-tuning, evaluation, embeddings, dataset construction, facial recognition, or generative-AI input without a separate written license.
• Use AI agents or crawlers to fetch image derivatives contrary to robots.txt, /.well-known/tdmrep.json, tdm-reservation response headers, access controls, or rate limits.
• Manipulate the Site’s navigation or presentation.
• Interfere with the security or operation of the Site.
• Register an account under a false name or with invalid information.

3. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of cosmigo GmbH or its content suppliers and is protected by applicable copyright laws.

4. Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

5. Purchases & Right of Withdrawal (Widerrufsbelehrung)

All purchases are subject to our License Agreement. Pricing and availability of Content are subject to change without notice. Statutory consumer rights remain unaffected.

Right of Withdrawal for Digital Content: If you are a consumer in the European Union, you generally have a 14-day statutory right of withdrawal. However, pursuant to Section 356 (5) of the German Civil Code (BGB) / EU Consumer Rights Directive, the right of withdrawal expires prematurely in the case of contracts for the supply of digital content not supplied on a tangible medium once performance of the contract has begun after you have explicitly agreed that we begin performance before the expiration of the withdrawal period and you have acknowledged that you thereby lose your right of withdrawal upon commencement of the download or delivery.

6. Limitation of Liability

cosmigo GmbH has unlimited liability for intent and gross negligence; culpable injury to life, body, or health; an expressly assumed guarantee; fraudulent concealment; and liability that cannot legally be limited. For slight negligence, liability exists only for breach of an essential contractual duty and is limited to loss typical of the contract and reasonably foreseeable when it was made. In all other cases, liability for slight negligence is excluded to the extent permitted by law. Mandatory consumer rights remain unaffected.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Mandatory statutory jurisdiction rules remain unaffected.

8. Contracting Party

The Site is operated by cosmigo GmbH. Its managing director, employees, and content suppliers do not personally become parties to a Site or license contract and give no personal guarantee unless expressly agreed in writing. Mandatory statutory personal liability remains unaffected.
